Terms of Service

Effective Date: February 25, 2026

These Terms of Service ("Terms") govern your access to and use of the ShootSmart Photographers Toolkit mobile application (available on iOS and Android), the ShootSmart web application, and all associated services, content, and features (collectively, the "Services"), operated by ShootSmart ("we," "us," or "our"). By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Acceptance of Terms

By creating an account, downloading the app from the Apple App Store or Google Play Store, or accessing any portion of our Services (including the web application at shootsmart.info), you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them, along with our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

ShootSmart provides a suite of tools and resources designed to help photographers of all skill levels. The Services include:

  • Photography Calculators & Tools: Exposure calculators, depth-of-field calculators, bokeh simulators, hyperfocal distance tools, and other technical photography utilities.
  • AI Photography Assistant: An artificial intelligence-powered assistant that provides personalized photography tips, technique guidance, gear recommendations, and contextual advice based on your inputs and preferences.
  • Photography Guides: Curated educational content covering camera settings, composition techniques, lighting, post-processing, and genre-specific photography topics.
  • Account & Sync: A Photographer ID-based account system that synchronizes your settings, preferences, and saved data across your iOS, Android, and Web sessions.
  • Support System: An integrated ticketing system for technical support and user assistance.

We may add, modify, or discontinue any feature or aspect of the Services at any time, with or without notice.

3. User Accounts and Photographer ID

  • Account Creation: To access certain features, you must create an account and will be assigned a unique Photographer ID. You must provide accurate, complete, and current information.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@shootsmart.info if you suspect any unauthorized access to your account.
  • Account Responsibility: You are solely responsible for all activity that occurs under your account and Photographer ID, including any actions taken using the AI Assistant or data entered into any ShootSmart tool.
  • Single Account: Each account is intended for use by one individual. You may not share your account credentials with others or create accounts on behalf of third parties without authorization.
  • Account Termination: We may suspend or terminate your account at our discretion, including for violation of these Terms, fraudulent activity, or prolonged inactivity.

4. Subscriptions, In-App Purchases, and Billing

Certain features of ShootSmart may require a paid subscription or one-time in-app purchase.

  • App Store Purchases: If you purchase a subscription or in-app product through the Apple App Store or Google Play Store, billing is managed entirely by Apple or Google, respectively. Their terms, refund policies, and billing cycles apply. We do not have access to your payment card information for purchases made through those platforms.
  • Subscription Renewals: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date through your Apple ID or Google Play account settings.
  • Cancellation: You may cancel a subscription at any time through the App Store or Google Play. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
  • Refunds: Refund requests for App Store or Google Play purchases must be directed to Apple or Google. We do not process refunds for purchases made through those platforms. For any purchases made directly through our website, refund requests may be submitted to support@shootsmart.info within 14 days of purchase.
  • Free Tier: A limited set of features may be available without payment. We reserve the right to modify what is included in the free tier at any time.
  • Price Changes: We may change subscription pricing. We will notify you in advance of any price change applicable to your subscription, and your continued use after the effective date constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use the Services only for lawful, legitimate photography-related purposes. You must not:

  • Use the Services in any way that violates applicable local, national, or international laws or regulations.
  • Attempt to gain unauthorized access to any part of the Services, our servers, or any system or network connected to the Services.
  • Use automated scripts, bots, scrapers, or other tools to extract data from the Services without our express written permission.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app or any component of the Services.
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
  • Transmit any harmful, offensive, or unlawful content through the support system or any other communication channel provided by the Services.
  • Use the AI Photography Assistant for any purpose other than legitimate photography guidance — including attempts to extract harmful, illegal, or unrelated content.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. AI Photography Assistant

The AI Photography Assistant uses artificial intelligence to provide photography guidance, technique suggestions, gear recommendations, and creative feedback. By using this feature, you acknowledge and agree that:

  • Not Professional Advice: Responses from the AI Assistant are generated automatically and for informational and educational purposes only. They do not constitute professional photography, legal, financial, or any other type of regulated advice.
  • Accuracy: While we strive for accuracy, AI-generated responses may be incomplete, outdated, or incorrect. You should independently verify any technical information before relying on it.
  • Data Processing: Your messages and conversation history with the AI Assistant may be processed by third-party AI providers. Please review our Privacy Policy for details on how this data is handled.
  • Content Standards: You agree not to use the AI Assistant to generate content that is harmful, abusive, harassing, defamatory, or otherwise objectionable.
  • No Guarantee of Availability: The AI Assistant requires an active internet connection and may be temporarily unavailable due to maintenance, high demand, or third-party service outages.

7. Camera, Photo, and Device Permissions

The ShootSmart app may request access to certain device features to provide full functionality:

  • Camera: Camera access may be requested for certain tools. We do not capture or store photos without your explicit action.
  • Photo Library: If you choose to import images for analysis or reference, access to your photo library may be requested. We do not access your photos without your initiation.
  • Location: GPS or location data may be requested for location-based photography features such as golden hour calculations, weather conditions, or sunrise/sunset times. Location data is used in-app and is not stored on our servers unless you explicitly save a location preference.
  • Notifications: Push notifications may be used to inform you of app updates, support ticket replies, or photography tips (with your consent). You can manage notification preferences in your device settings at any time.

You may revoke any permission at any time through your device settings. Revoking a permission may limit the availability of certain features.

8. Photography Guides and Educational Content

All photography guides, articles, tutorials, and educational content provided within the Services are owned by ShootSmart or its licensors and are protected by applicable intellectual property laws. This content is provided for personal, non-commercial educational use only. You may not reproduce, republish, distribute, sell, or sublicense any guide or article without our prior written consent.

9. Data Sync and Cross-Platform Use

ShootSmart allows you to access your account and synchronized data across iOS, Android, and the web. You understand that:

  • Sync requires an active internet connection. We are not responsible for data loss resulting from connection failures, device failure, or failure to sync.
  • While we take reasonable precautions to back up your data, we strongly recommend maintaining your own copies of any critical photography data or settings.
  • Upon account termination, your synced data may be permanently deleted. See our Privacy Policy for data retention details.

10. Intellectual Property

  • Ownership: All content, features, designs, trademarks, logos, and functionality of the Services — including the ShootSmart name, the app interface, all tools, and all guides — are owned by ShootSmart or its licensors and are protected by copyright, trademark, and other intellectual property laws.
  • License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your personal, non-commercial use in accordance with these Terms.
  • Restrictions: You may not copy, modify, adapt, translate, create derivative works from, reverse engineer, or distribute any portion of the Services or its content without our express written consent.
  • Your Content: Any photography settings, preferences, or data you input into the app remains yours. By using the Services, you grant us a limited license to store and process that data solely to provide the Services to you.

11. Third-Party Services

The Services may integrate with or link to third-party services including, but not limited to, Apple App Store, Google Play Store, AI model providers, analytics services, and cloud infrastructure providers. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of any third-party service.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RESULTS OBTAINED THROUGH THE PHOTOGRAPHY TOOLS AND CALCULATORS ARE ESTIMATES AND MAY NOT BE SUITABLE FOR ALL SHOOTING CONDITIONS. USE YOUR OWN PROFESSIONAL JUDGMENT WHEN APPLYING ANY CALCULATION OR AI RECOMMENDATION.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHOOTSMART AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • Any damages resulting from your reliance on tool calculations, AI recommendations, or guide content.
  • Any loss of photographs, camera settings, or other data resulting from sync failures, device issues, or app errors.
  • Any unauthorized access to your account or data resulting from circumstances beyond our reasonable control.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $10 USD.

14. Indemnification

You agree to defend, indemnify, and hold harmless ShootSmart and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

15. Privacy

Our collection and use of personal information in connection with the Services is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

16. App Store Additional Terms

If you download the ShootSmart app from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and ShootSmart only, not with Apple, Inc. Apple is not responsible for the app or its content.
  • Apple has no obligation to furnish any maintenance or support services for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app.
  • Apple is a third-party beneficiary of these Terms and has the right (and is deemed to have accepted the right) to enforce them against you.

If you download the ShootSmart app from the Google Play Store, your use is also subject to the Google Play Terms of Service.

17. Updates to the App and Services

We may release updates to the ShootSmart app from time to time. Updates may include bug fixes, new features, or changes to existing features. You are encouraged to keep the app updated to the latest version. Some updates may be required to continue using the Services. We are not responsible for any issues arising from your use of an outdated version of the app.

18. Termination

Either party may terminate this agreement at any time. You may stop using the Services and delete the app at any time. We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) shall survive.

19. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or an in-app notification. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States and the state in which ShootSmart is headquartered, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights or confidential information.

21. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

22. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and ShootSmart with respect to the Services and supersede all prior agreements, representations, and understandings.
